Dear SBC Roads and Neighbourhood staff members please find below a message from our RIO Willie Thomson with regards to the letter you received from the council asking you to sign a letter agreeing to contractual stand by. Please share this information with your colleagues who may no have an e mail address.
As a result of Scottish Borders Council’s imposed changes to your existing contractual agreement we are currently in dispute. Your industrial action ballot will close on 25th June, please ensure that you have voted Yes for industrial action and you have returned your ballot paper to the Electoral Reform Service.
Your union has been made aware that Scottish Borders Council has contacted you directly in relation to future arrangements for the delivery of the Roads & Infrastructure Service and in particular the arrangements for the emergency cover and your colleagues provide.
The correspondence from SBC raises some serious concerns which have been referred to our legal department. Section 145B of the Trade Union Relations [Consolidation] Act 1992 (TULR(C)A) is clear that it is unlawful for an employer to offer members of an independent trade union that is recognised an inducement to stop or prevent collective bargaining. We believe the actions of SBC may be a breach of this legislation. Unite members who have been contacted directly by SBC in relation to changes to emergency cover are invited to contact their shop stewards to register their interest in a potential claim for an illegal inducement.
If Scottish Borders Council wishes to resolve the matters that are outstanding to our members in the Roads & Infrastructure Service it the way forward is to meet with Unite to negotiate in a meaningful way.
